ORDER OF PRIORITY FOR PAYMENT OF

FIRST-PARTY NO-FAULT BENEFITS

 

A.    If the injured party is the operator or occupant of a motor vehicle, then the order of priority is established by MCL 500.3114(1) as follows:

    1.     The operator or occupant's own insurer;

    2.     Insurer(s) of his or her spouse and relatives domiciled in the same household;

    3.     The insured of the owner or the registrant of the motor vehicle being operated or occupied;

    4.     The insurer of the operator of the motor vehicle being occupied;

    5.     The Assigned Claims Fund (see MCL 500.3171).

B.     If the injured party is an occupant of a vehicle for hire or an occupant of public transportation, the order of priority is established by MCL 500.3114(2) as follows:

    1.     The insurer of the owner of the motor vehicle occupied;

    2.     The insurer(s) of the occupant;

    3.     The insurer(s) of his or her spouse and relatives domiciled in the same household;

    4.     The insurer of the driver of the motor vehicle occupied;

    5.     The Assigned Claims Fund (see MCL 500.3171).

C.     If the injured party is an occupant of employer furnished vehicle, the order of priority is established by MCL 500.3114(3) as follows:

    1.     The employer's insurer;

    2.     The occupant's insurer;

    3.     The insurer(s) of the spouse or relatives domiciled in the same household;

    4.     The insurer of the driver of the occupied motor vehicle;

    5.     The Assigned Claims Fund (see MCL 500.3171).

D.     If the injured party is the operator/passenger of a motorcycle, the order of priority is established by MCL 500.3114(5) as follows:

    1.     The insurer of the owner or registrant of the motor vehicle involved;

    2.     The insurer of the operator of the motor vehicle involved;

    3.     The insurer of the motorcycle operator;

    4.     The motorcycle owner's insurer;

    5.     The Assigned Claims Fund (see MCL 500.3171).

E.     If the injured party is a non-occupant of a motor vehicle, the order of priorities is established by MCL 500.3115(1) as follows:

    1.     The insurer of the non-occupant;

    2.     The insurer(s) of the spouse and relatives domiciled in the same household;

    3.     The insurer(s) of the owners or registrants of the motor vehicles involved;

    4.     The insurer(s) of the operators of the motor vehicles involved;

    5.     The Assigned Claims Fund (see MCL 500.3171).
